
Law 36-23 took effect in the National District on July 1, 2023, and specifically amends Articles 15, 16, 16.1, and 17 of Law 50-87 on Chambers of Commerce and Production of the Republic.
Among the new provisions of Law 36-23 are the following:
i. changing the name of our Alternative Dispute Resolution Center to “Court of Arbitration and Alternative Dispute Resolution”;
ii. the adaptation of the law to modern practice, by establishing that disputes submitted to arbitration tribunals and alternative dispute resolution forums are governed by the rules in effect at the time the request or claim is filed, unless the parties have agreed otherwise;
iii. rather than listing the grounds for an action to set aside an arbitral award, a reference to the grounds for nullity provided for in Law 489-08 on Commercial Arbitration;
iv. a statement that arbitration courts and alternative dispute resolution bodies may adjudicate sports disputes when the parties have so agreed or when acting as a delegated institution;
v. the adaptation of the law to practical legal reality by establishing the position of deputy secretary;
vi. changing the title of the position from executive secretary to secretary general; and
vii. the standardization and correction of the terminology used in the law.
