SCJ establishes Constitutional Court can pursue enforcement of its own rulings as they are final 

The Third Chamber of the Supreme Court of Justice established that the Constitutional Court is responsible for the execution of its own decisions, as provided by Article 9 of Law No. 137-11, the Organic Law of the Constitutional Court. 

In its ruling number SCJ-TS-23-0047, dated January 31, 2023, the Third Chamber of the SCJ points out that Article 26 of the Jurisdictional Regulation of the Constitutional Court provides that “the Sentence Execution Monitoring Unit (USES) pursues the effective execution of the Court's sentences through the structuring of mechanisms for the reception, investigation, and processing of requests aimed at resolving difficulties or non-compliance with its decisions.”. 

The appeal in cassation was filed by a member of the National Police who obtained a favorable ruling on appeal for his reinstatement to the law enforcement institution, with the same rank he held at the time of his dismissal, in addition to seeking payment of the salaries he failed to receive from the time of his separation until the date of his reinstatement. 

The decision of the Third Chamber annuls ruling no. 0030-04-2021-SSEN-00440, dated August 3, 2021, issued by the Third Chamber of the Superior Administrative Court, and remands the matter to the Constitutional Court.
