{"id":2428,"date":"2024-07-22T19:24:33","date_gmt":"2024-07-22T19:24:33","guid":{"rendered":"https:\/\/poderjudicial.gob.do\/?p=40769"},"modified":"2024-07-22T19:24:33","modified_gmt":"2024-07-22T19:24:33","slug":"la-cour-supreme-de-justice-scj-etablit-quil-incombe-a-lemployeur-de-prouver-la-juste-cause-du-licenciement","status":"publish","type":"post","link":"https:\/\/jnlopez.com\/francais\/2024\/07\/22\/scj-establece-corresponde-al-empleador-probar-justa-causa-del-despido\/","title":{"rendered":"La SCJ \u00e9tablit qu'il incombe \u00e0 l'employeur de prouver la juste cause du licenciement\u00a0"},"content":{"rendered":"<div><img decoding=\"async\" data-src=\"https:\/\/poderjudicial.gob.do\/wp-content\/uploads\/2024\/07\/DSC06362-scaled.jpg\" class=\"ff-og-image-inserted lazyload\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\"><\/div>\n<p>La Troisi\u00e8me Chambre de la Cour supr\u00eame de justice est d'avis que, conform\u00e9ment \u00e0 l'article 16 du Code du travail et de ses r\u00e8glements, c'est l'employeur qui doit prouver, sur la base de registres, de feuilles de paie, d'affichages, du livre des salaires et de la paie, si la r\u00e9mun\u00e9ration re\u00e7ue par un travailleur et la cotisation d\u00e9clar\u00e9e \u00e0 la Tr\u00e9sorerie de la S\u00e9curit\u00e9 sociale (TSS) sont inf\u00e9rieures au montant que celui-ci all\u00e9guera.&nbsp;<\/p>\n<p>\u201c Il convient d'\u00e9tablir qu'il incombe \u00e0 l'employeur de prouver la juste cause du licenciement ; la preuve de la juste cause du licenciement doit \u00eatre apport\u00e9e \u00e0 chaque instance, c'est-\u00e0-dire devant la juridiction de premi\u00e8re instance et au niveau de l'appel \u201d, souligne la d\u00e9cision.&nbsp;<\/p>\n<p>Dans son arr\u00eat <strong>SCJ-TS-23-1171<\/strong>, en date du 20 octobre 2023, le tribunal indique que \u201c la jurisprudence est constante en ce sens que la fixation du montant du salaire d'un travailleur demandeur en paiement d'indemnit\u00e9s de travail est une question de fait relevant des juges du fond, qui \u00e9chappe au contr\u00f4le de la cassation, sauf si ces derniers, en proc\u00e9dant ainsi, commettent une d\u00e9naturation \u201d.&nbsp;<\/p>\n<p>De m\u00eame, la jurisprudence \u00e9tablit que, pour d\u00e9terminer le montant du salaire aux fins du paiement des indemnit\u00e9s de licenciement au travailleur, il convient de prendre en compte les salaires per\u00e7us au cours de la derni\u00e8re ann\u00e9e de prestation de service, y compris les retenues que l'employeur doit effectuer \u00e0 quelque titre que ce soit, pour autant qu'il s'agisse de d\u00e9ductions sur son salaire ordinaire.&nbsp;<\/p>\n<p>L'arr\u00eat de la Troisi\u00e8me Chambre de la SCJ casse l'arr\u00eat n\u00b0. <strong>028-2022-SSEN-00318<\/strong>, en date du 13 octobre 2022, rendue par la Premi\u00e8re Chambre de la Cour du travail du District national, et renvoie l'affaire devant la Deuxi\u00e8me Chambre de la m\u00eame Cour.&nbsp;<\/p>\n<p>Pour acc\u00e9der int\u00e9gralement \u00e0 l'arr\u00eat, sign\u00e9 par les magistrats Manuel Alexis Read Ortiz, pr\u00e9sident ; Manuel R.
