Les chambres r\u00e9unies de la Cour supr\u00eame de justice ont \u00e9tabli que toute r\u00e9gularisation effectu\u00e9e a posteriori sur une parcelle d\u00e9j\u00e0 r\u00e9gularis\u00e9e est nulle, \u201c car la possession constitue le fondement de toute r\u00e9gularisation, c'est-\u00e0-dire la reconnaissance ou l'acquisition d'un droit sur un bien immobilier \u201d. <\/p>\n

Par arr\u00eat n\u00b0 SCJ-SR-23-00046<\/strong>, en date du 31 mars 2023, les Chambres r\u00e9unies soutiennent qu\u2019une fois un terrain assaini, celui-ci entre dans le syst\u00e8me d\u2019enregistrement dit \u00ab syst\u00e8me Torrens \u00bb, et que cet assainissement a pour effet d\u2019effacer tous les droits ant\u00e9rieurs ; par cons\u00e9quent, il n\u2019existe aucun droit valable qui ne figure pas dans le registre foncier correspondant. <\/p>\n

Dans cet ordre d'id\u00e9es, souligne la d\u00e9cision, une deuxi\u00e8me proc\u00e9dure d'assainissement ne peut modifier les droits conf\u00e9r\u00e9s lors de la premi\u00e8re proc\u00e9dure d'assainissement une fois que le jugement qui y met fin a acquis force de chose jug\u00e9e. <\/p>\n

\u201c Il est important de souligner que, d'un point de vue cadastral, est consid\u00e9r\u00e9 comme propri\u00e9taire toute personne qui fait inscrire son droit au registre foncier correspondant \u201d, ajoute l'arr\u00eat du tribunal.     <\/p>\n

Pour ces motifs et apr\u00e8s d\u00e9lib\u00e9ration, les Chambres r\u00e9unies rejettent le pourvoi en cassation form\u00e9 contre l'arr\u00eat n\u00b0 201900062, rendu le 14 f\u00e9vrier 2019, par le Tribunal sup\u00e9rieur foncier du d\u00e9partement de l\u2019Est, statuant en qualit\u00e9 de juridiction de renvoi. <\/p>\n

La d\u00e9cision ci-dessus a \u00e9t\u00e9 sign\u00e9e par les magistrats Henry Molina (pr\u00e9sident), Pilar Jim\u00e9nez Ortiz, Francisco Antonio Jerez Mena, Fran Euclides Soto S\u00e1nchez, Justiniano Montero Montero, Anselmo A. Bello Ferreras, Vanessa Elizabeth Acosta Peralta, Napole\u00f3n Ricardo Est\u00e9vez Lavandier, Samuel Amaury Arias Arzeno, Mar\u00eda Gerinelda Garabito Ram\u00edrez, Mois\u00e9s Alfredo Ferrer Landr\u00f3n et Francisco Antonio Ortega Polanco. <\/p>\n
