La loi n\u00b0 36-23 est entr\u00e9e en vigueur dans le District national le 1er juillet 2023 et modifie notamment les articles 15, 16, 16.1 et 17 de la loi n\u00b0 50-87 relative aux chambres de commerce et de production de la R\u00e9publique.<\/p>\n

Parmi les nouveaut\u00e9s de cette loi n\u00b0 36-23, on peut citer :<\/p>\n

i. le changement de nom de notre Centre de r\u00e8glement extrajudiciaire des litiges, qui devient d\u00e9sormais la \u201c Cour d'arbitrage et de r\u00e8glement extrajudiciaire des conflits \u201d ;<\/p>\n

ii. l'adaptation de la loi aux pratiques modernes, en pr\u00e9cisant que les litiges soumis aux tribunaux d'arbitrage et aux instances de r\u00e8glement alternatif des litiges sont r\u00e9gis par les r\u00e8glements en vigueur au moment du d\u00e9p\u00f4t de la demande ou de la r\u00e9clamation, sauf accord contraire entre les parties ;<\/p>\n

iii. au lieu d'\u00e9num\u00e9rer les motifs pouvant donner lieu \u00e0 une action en nullit\u00e9 d'une sentence arbitrale, il convient de se r\u00e9f\u00e9rer aux motifs de nullit\u00e9 pr\u00e9vus par la loi n\u00b0 489-08 relative \u00e0 l'arbitrage commercial ;<\/p>\n

iv. la mention selon laquelle les tribunaux d'arbitrage et de r\u00e8glement alternatif des litiges peuvent traiter les litiges sportifs lorsque les parties en ont ainsi convenu ou en tant qu'institution mandat\u00e9e ;<\/p>\n

v. l'adaptation de la loi \u00e0 la r\u00e9alit\u00e9 juridique pratique, par la cr\u00e9ation de la fonction de secr\u00e9taire adjoint ;<\/p>\n

vi. la modification de l'intitul\u00e9 du poste de \u00ab secr\u00e9taire ex\u00e9cutif \u00bb en \u00ab secr\u00e9taire g\u00e9n\u00e9ral \u00bb ; et<\/p>\n

vii. l'harmonisation et la correction de la terminologie utilis\u00e9e dans la loi.<\/p>\n
