{"id":2298,"date":"2023-10-10T18:06:18","date_gmt":"2023-10-10T18:06:18","guid":{"rendered":"https:\/\/poderjudicial.gob.do\/?p=38688"},"modified":"2023-10-10T18:06:18","modified_gmt":"2023-10-10T18:06:18","slug":"scj-reafirma-criterio-establece-derecho-al-secreto-bancario-e-intimidad-personal","status":"publish","type":"post","link":"https:\/\/jnlopez.com\/francais\/2023\/10\/10\/scj-reafirma-criterio-establece-derecho-al-secreto-bancario-e-intimidad-personal\/","title":{"rendered":"La SCJ r\u00e9affirme le crit\u00e8re \u00e9tablissant le droit au secret bancaire et \u00e0 l'intimit\u00e9 personnelle\u00a0"},"content":{"rendered":"<div><img decoding=\"async\" data-src=\"https:\/\/poderjudicial.gob.do\/wp-content\/uploads\/2023\/10\/MicrosoftTeams-image-384-scaled.jpg\" class=\"ff-og-image-inserted lazyload\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\"><\/div>\n<div class=\"elementor-widget-container\" readability=\"29.67583497053\">\n<p>La Sala Penal de la Suprema Corte de Justicia reafirm\u00f3 el criterio que establece que una de las reglas de la actividad bancaria y financiera es la confidencialidad y el secreto bancario, de manera tal que las negociaciones y transacciones que realizan los intermediarios financieros no pueden divulgarse a terceros, salvo en los casos en que, en inter\u00e9s de la administraci\u00f3n de la justicia, y previa orden de un juez, se disponga lo contrario.&nbsp;<\/p>\n<p>Mediante sentencia n\u00famero SCJ-SS-23-0335, de fecha 31 de marzo de 2023, los jueces de la citada Sala sostienen que la Constituci\u00f3n dominicana establece claramente en su art\u00edculo 44 la protecci\u00f3n a la intimidad.&nbsp;<\/p>\n<p>\u201cEs bien sabido que el secreto bancario es un derecho fundamental de todos, y para acceder a la informaci\u00f3n bancaria de cualquier persona debe mediar la ponderaci\u00f3n de un juez de la instrucci\u00f3n, quien debe observar, antes de emitir una orden, que los derechos fundamentales de ese sujeto de investigaci\u00f3n est\u00e1n garantizados en todo momento\u201d, subraya la decisi\u00f3n.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n<p>El proceso que nos ocupa inicia por una denuncia de defraudaci\u00f3n tributaria depositada ante el Ministerio P\u00fablico por la Direcci\u00f3n General de Impuestos Internos (DGII), en atenci\u00f3n a las disposiciones del art\u00edculo 234 del C\u00f3digo Tributario, el cual establece, entre otras cosas, que <em>la administraci\u00f3n tributaria, en los casos que tome conocimiento de hechos constitutivos de delito, deber\u00e1 iniciar ante la justicia ordinaria la acci\u00f3n penal<\/em><em>.<\/em>&nbsp;<\/p>\n<p>En ese sentido, los jueces de la Sala Penal: Francisco Antonio Jerez Mena (presidente), Nancy I. Salcedo Fern\u00e1ndez, Fran Euclides Soto S\u00e1nchez y Mar\u00eda G. Garabito Ram\u00edrez, rechazaron el recurso de casaci\u00f3n contra la sentencia penal n\u00fam. 502-2022-SSEN-00050, dictada por la Segunda Sala de la C\u00e1mara Penal de la Corte de Apelaci\u00f3n
