{"id":2183,"date":"2023-04-25T16:37:52","date_gmt":"2023-04-25T16:37:52","guid":{"rendered":"https:\/\/poderjudicial.gob.do\/?p=36904"},"modified":"2023-04-25T16:37:52","modified_gmt":"2023-04-25T16:37:52","slug":"magistradas-de-iberoamerica-se-comprometen-a-proteger-el-derecho-al-cuidado-como-un-bien-comun-de-la-humanidad-a-ser-tutelado-por-el-estado","status":"publish","type":"post","link":"https:\/\/jnlopez.com\/de\/2023\/04\/25\/magistradas-de-iberoamerica-se-comprometen-a-proteger-el-derecho-al-cuidado-como-un-bien-comun-de-la-humanidad-a-ser-tutelado-por-el-estado\/","title":{"rendered":"Magistratinnen Iberoamerikas verpflichten sich, das Recht auf F\u00fcrsorge als ein von dem Staat zu sch\u00fctzendes Gemeingut der Menschheit zu sch\u00fctzen\u00a0"},"content":{"rendered":"<div><img decoding=\"async\" data-src=\"https:\/\/poderjudicial.gob.do\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-256.png\" class=\"ff-og-image-inserted lazyload\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\"><\/div>\n<p>El XIX Encuentro de Magistradas de los M\u00e1s Altos \u00d3rganos de Justicia de Iberoam\u00e9rica concluy\u00f3 con la firma de la Declaraci\u00f3n de Buenos Aires, \u201cPor Una Justicia de G\u00e9nero\u201d: Justicia y Cuidado con Corresponsabilidad\u201d, en la que se comprometen a asumir la responsabilidad de proteger el derecho al cuidado como un bien com\u00fan de la humanidad que debe ser tutelado por los Estados y la sociedad en general.&nbsp;&nbsp;<\/p>\n<p>La Declaraci\u00f3n de Buenos Aires, de fecha 21 de abril de 2023, se sustenta en los tratados internacionales de&nbsp;derechos humanos que proclaman en su contenido los principios de igualdad, no discriminaci\u00f3n y una vida libre de violencia en relaci\u00f3n al derecho al cuidado.&nbsp;<\/p>\n<p>Las magistradas tambi\u00e9n se comprometieron a transversalizar el enfoque de los derechos humanos con perspectiva de g\u00e9nero desde la interseccionalidad, que permita reconocer el pleno goce y disfrute de los derechos humanos de las personas prestadoras de los servicios de cuidado y de las receptoras de los mismos.&nbsp;<\/p>\n<p>Asimismo, erradicar la violencia que viven las ni\u00f1as y adolescentes obligadas a asumir responsabilidades de cuidado, as\u00ed como los estereotipos culturales discriminatorios como sexismo, adulto centrismo, edaismo, capacitismo, clasismo, racismo, la xenofobia, la lesbo-homo-transfobia en los sistemas de cuidados.&nbsp;<\/p>\n<p>La declaraci\u00f3n de Buenos Aires tambi\u00e9n contempla consolidar los sistemas nacionales de cuidado desde la calidad de los servicios, la diversidad y la cobertura geogr\u00e1fica con est\u00e1ndares internacionales que permitan recibir un servicio acorde con lo establecido en los tratados internacionales de protecci\u00f3n de los derechos humanos.&nbsp;<\/p>\n<p>El XIX Encuentro de Magistradas de los M\u00e1s Altos \u00d3rganos de Justicia de Iberoam\u00e9rica: por una justicia de g\u00e9nero, fue realizado en Buenos Aires, Argentina y reuni\u00f3 a juezas y exjuezas de esa naci\u00f3n, de Rep\u00fablica Dominicana, Uruguay, Paraguay, Guatemala, Bolivia, M\u00e9xico, Colombia, Costa Rica, El Salvador, Honduras y Espa\u00f1a, cuyos sistemas de justicia buscan promover perspectivas de g\u00e9nero con patrones socioculturales de cuidado a las mujeres.&nbsp;<\/p>\n<p>La delegaci\u00f3n de Rep\u00fablica Dominicana estuvo integrada por las juezas de la Suprema Corte de Justicia (SCJ), Nancy Salcedo Fern\u00e1ndez, Pilar Jim\u00e9nez Ortiz, Vanessa Acosta Peralta y Mar\u00eda G. Garabito; adem\u00e1s, las\u202fconsejeras Bionni Zayas y Octavia Carolina Fern\u00e1ndez.\u202f&nbsp;<\/p>\n<p>Durante su participaci\u00f3n, la magistrada Salcedo Fern\u00e1ndez, quien tambi\u00e9n coordina la Comisi\u00f3n para la Igualdad de G\u00e9nero del Poder Judicial, destac\u00f3 las iniciativas impulsadas en este poder del Estado para garantizar el cuidado en el sistema protecci\u00f3n integral del ni\u00f1o, la ni\u00f1a y el inter\u00e9s superior.&nbsp;<\/p>\n<p>Salcedo Fern\u00e1ndez detall\u00f3 entre esas iniciativas la creaci\u00f3n de las salas de lactancia, la implementaci\u00f3n de la Pol\u00edtica General de Teletrabajo, ampliaci\u00f3n de la licencia de paternidad, la realizaci\u00f3n de capacitaciones sobre paternidad responsable (la nueva masculinidad) y su rol con el cuidado de hijos e hijas.&nbsp;<\/p>\n<p>Dijo que tambi\u00e9n figuran la realizaci\u00f3n de cursos y talleres sobre comunicaci\u00f3n efectiva, autocuidado y bienestar desde la Escuela Nacional de la Judicatura<strong> <\/strong>y la<strong> <\/strong>elaboraci\u00f3n de actividades con el personal enfocadas a la equidad, que promueve la conciliaci\u00f3n laboral y familiar.&nbsp;<\/p>\n<p>De su lado, la magistrada Octavia Carolina Fern\u00e1ndez, integrante del Consejo del Poder Judicial, quien en el encuentro coordin\u00f3 el tema \u201cEl Derecho a la Autonom\u00eda Personal del Cuidado de las Personas con Discapacidad\u201d, consider\u00f3 que las personas con esa condici\u00f3n deben ser cuidadas, respetando su autoestima y derecho a decidir.&nbsp;<\/p>\n<p> <a href=\"https:\/\/poderjudicial.gob.do\/magistradas-de-iberoamerica-se-comprometen-a-proteger-el-derecho-al-cuidado-como-un-bien-comun-de-la-humanidad-a-ser-tutelado-por-el-estado\/\">Quelle<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p> Das XIX.
